From: Sion Buckler <[redacted]> Date: Wed, 5 Nov 2025 02:59:13 -0300 Subject: BP Properties Ltd v Buckler – Request for Opinion (Limitation Act 1980 s.32) Message-ID: Dear Mr Thomas, I am seeking a preliminary opinion regarding potential grounds to reopen the case BP Properties Ltd v Buckler (Court of Appeal, 31 July 1987), concerning Great House Farm, Llandough, Vale of Glamorgan. There appear to be two material issues: 1. Corporate Party Identification: Correspondence relevant to the dispute was exchanged with BP Pension Trust Ltd, while litigation and enforcement proceeded under BP Properties Ltd. The Court treated these entities as separate when assessing notice but effectively identical in dismissing the appeal and enforcing possession. This inconsistency may constitute a mistake or misrepresentation under Limitation Act 1980, Section 32. 2. Effect of the 1974 Letters: The Court found that unilateral letters in 1974 granting a licence to occupy rent-free for life converted possession from adverse to licensed. However, I understand there is no evidence that this licence was ever accepted. If acceptance did not occur, adverse possession may have continued and the running of limitation may not have been interrupted as the judgment assumes. I would be grateful for: Your view on whether these issues may be sufficient to apply to set aside or reopen enforcement, or otherwise seek remedy or restitution; and Your guidance on next procedural steps. I can provide Judgment text and Newspaper records of the demolition (1988) etc. Thank you for your consideration. Yours sincerely, Sion Hywel Buckler [redacted]
