In Ms St Rose’s absence, I have put your request to the ICR today. She has asked me to confirm that her decision not to investigate further was final. Yours sincerely Chris Jackson (Mr) Senior Investigation Officer Office of the Independent Complaints Reviewer 10 South Colonnade, Canary Wharf, London [postcode redacted]. I have read the Independent Complaints Reviewer's decision carefully and I understand that she cannot review HM Land Registry's legal decisions, assess the evidence, or revisit the 1987 litigation. I am not asking her to do any of those things. Your letter explains that the ICR "can give a view on whether HMLR has followed its standard procedure in reviewing registration decisions and whether its complaint responses clearly and fully deal with the matters within HMLR's remit". I respectfully ask her to reconsider on that limited basis only. HMLR's replies to me (23 March, 19 April, 25 May and 30 July 2026) did not answer three factual questions about HMLR's own records, each of which is within HMLR's remit and none of which asks HMLR or the ICR to decide who owns the land: 1. whether HMLR's records show that any enquiry or notice was sent to the occupiers of the farmhouse before the first registrations of 1982–83, and if so to whom, at what address and on what date. The Stage 2 response says HMLR "did not receive or were aware of any interest that you or your family may or may not have had in the land"; it does not say whether a notice was sent; 2. why the conveyance of 31 December 1969, relied on as the root of title, does not appear in the schedule of documents on the first-registration file released on 30 July 2026, and whether HMLR holds it under any other reference; 3. on what application the two titles were amalgamated on 2 February 1987, and whether the record shows what was known then about the pending appeal. One small point of record: your letter refers to the Stage 1 response as dated 19 April 2025. I believe it is dated 19 April 2026. If the ICR will not reconsider, please confirm in writing that her decision of 9 October 2026 is final, so that I can ask my MP to consider a referral to the Parliamentary and Health Service Ombudsman, enclosing your letter as you suggest. A reply by 6 November 2026 would be appreciated. I hold the stage-one decision of 19 April 2026 and the stage-two decision of 25 May 2026. I also hold the schedule of 43 documents on the first-registration files released on 30 July 2026. The family’s established case, recorded on the public wiki and under investigation, is that the 1877 arrangement took effect in 1928, transferring the full Parcel A (house and buildings, barn, stable and west-side yard, garden, northern forest and the south-east ground later registered as VG41) to the Williams family. The 1939 agreement/plan depicts Parcel B only. On the family account, the 1949 attempt to make the occupation of Parcel A permissive failed, title papers were reported missing in 1950–52, and Western Ground Rents’ 4 July 1955 enforcement of Parcel B also seized the Parcel-A forest and green under “whole farm” wording. Later documentary work is directed at corroborating or precisely mapping that account and tracing those areas into later titles. Four specific points remain unanswered and are relevant to that investigation: 1. The 1969 root deed recited as the root of title does not appear on the schedule. Please confirm whether HMLR holds that deed under any other reference, or whether it was never lodged. 2. What evidence exists on the file of notice or opportunity to object given to the occupying family (Williams / Buckler) in 1982–83. 3. The precise legal and administrative basis for the 1987 title amalgamation that took place while the Court of Appeal proceedings in BP Properties Ltd v Buckler were still live. 4. Whether the inclusion of the woodland (or any land beyond the 1938 conveyance) is regarded as a possible mistake capable of alteration or indemnity under the Land Registration Act 2002 and Practice Guide 39. Please confirm these points form part of the live investigation and state the exact start date of the ICR six-month period (so that the ~25 November 2026 outer limit can be verified).
