Subject: RE: Preservation notice — Great House Farm (Tŷ Mawr), Llandough — do not destroy records — Matter of public interest From: possessions.cardiff.countycourt Direction: received Date: Tue, 20 Oct 2026 10:49 UTC Institution: Ministry of Justice / HMCTS Refs: none Archive id: gm-1a158ee36fed63d2 ------------------------------------------------------------ OFFICIAL Good morning "Cardiff County Court Enquiries told me on 4 August 2026 that, because of the case's age, no records were held. Could you let me know the basis of that statement, so that I understand how it fits with your request for a claim" My colleague was not aware of your previous emails and the historical claim you are referring to. To assist you further and ensure we locate the correct matter we ask the parties to provide the claim number. We deal with several cases each day, and the claim number will help us identify the relevant case promptly. Answer to your emails: The County Court, Family Court, Court of Protection, and the District Registries of the High Court Records Retention and Disposition Schedule is the document that is used to manage the retention and destruction of records in HMCTS. 1. This schedule covers the court/tribunal records and associated administrative records held in the County Court, the Family Court, the Court of Protection and the District Registries of the High Court. It covers the records that are created and managed in line with Section 8 and Schedule 1, paragraph 4 of the Public Records Act 1958. HMCTS manages these public records on behalf of the Lord Chancellor. 2. It covers the records for the different jurisdictions and courts that sit in county court buildings (County court (civil), Family court, Court of Protection and District Registries of the High Court). 3. The schedule sets out how long these records should be kept (retention) and what should happen to the records when the retention period ends (disposition). It applies to records in all formats including, but not limited to, digital (for example case management systems or emails), paper and audio. 4. This schedule is in the public domain and published on GOV.uk website at: https://www.gov.uk/government/publications/record-retention-and-disposition-schedules. I have put everything I need to ask HMCTS into this one reply. 1. Claim numbers and the proceedings concerned I do not have claim numbers. The proceedings I know of concern Great House Farm (Tŷ Mawr), Llandough, near Penarth: - a possession order of 2 February 1955 and a Cardiff County Court order of 11 December 1962, in proceedings in which Western Ground Rents Ltd was the party seeking possession; - a possession action listed on 3 July 1974; - the possession order enforced in November 1988 following BP Properties Ltd v Buckler (High Court, Hollis J, July 1986; Court of Appeal [1987] EWCA Civ 2). These details come from the published judgment and family papers, so I may be wrong on some of them. 2. Surviving records Could you tell me whether any record, index entry, warrant or bailiff's return survives for these, or for the November 1988 enforcement? If not, were any transferred elsewhere (for example to a central HMCTS archive or The National Archives) or destroyed, and if so when and under which retention schedule? 3. The earlier "no records" reply Cardiff County Court Enquiries told me on 4 August 2026 that, because of the case's age, no records were held. Could you let me know the basis of that statement, so that I understand how it fits with your request for a claim number? If any of this is better handled under my Ministry of Justice subject access request (IR 260904007), please let me know. A reply by 2 November 2026 would be appreciated. Thank you for your help.
